【大會宣言】

六十一年前的12月10日,聯合國通過《世界人權宣言》,並將每年的12月10日定為「國際人權日」。國際社會藉著《宣言》共同宣告確認人類在公民、政治、經濟、社會及文化等各方面的普世天賦權利。自此以後,《宣言》成為追求社會公義及捍衛人權的指南,並促進此後半世紀各種人權的發展,亦是人民保障自己權利的根據。

然而,時至今日,侵權之事層出不窮,罄竹難書,譬如跨國剝削、貧富懸殊、跨代貧窮問題、人口販賣、兒童參與戰爭、政治逼害等等。在中國,「六四」事件至今仍未得到平反,當年學生和市民被無辜殺害,「六四」死難者親屬被剝奪自由悼念親人的權利,民運和維權人士被侵犯人身自由,幫助維權人士、上訪者及民運人士的律師也遭受各種形式的打壓。香港亦不能倖免。譬如法庭在維護人權時備受干預、市民仍未能普選行政長官及全體立法會議員、警察濫權情況嚴重、反歧視條例保障不足、言論自由屢受威脅、市民缺乏城市規劃話事權、青少年無法為自己身體作主及驗毒計畫漠視兒童主見權等等。我們都不能自我支配身心與生活。沒有自主,人權何在呢?

要充分保障我們的人權,讓我們自主生活,就要設立獨立及權力廣泛的人權委員會。聯合國多次建議香港設立人權委員會,惜政府藉詞推搪,推說現行制度行之有效。然而現時提倡及保障人權的工作散落於不同機構,譬如平等機會委員會、私隱專員公署及投訴警方獨立監察委員會等等。可是這些機構職權狹窄,委任過程黑箱作業,部分更缺乏資源,根本未能全面及有效保障人權。有見及此,我們要求政府立即設立人權委員會。

人權能否獲得有效保障,政府政策固然重要,我們的自主意識更為重要。我們作為自己的主人,有根據自己意志自決的權利,不容他人越庖代俎。要人權,我們的自覺及行動的勇氣更為關鍵。因此,我們呼籲大家,共同捍衛及爭取我們的天賦人權,抗衡社會種種的不公義。

Declaration of Human Rights Day 2009 – What are my rights? 

Universal Declaration of Human Rights was established 61 years by the United Nations on 10 December and declared this date as Human Rights Day. The international community recognizes that all human are born with civil, political, economic, social, cultural rights. Since then, the UDHR has been the compass for pursue social justice and defense for human rights that improve lives for more than half a century, it is also an important reference when individuals try to defense their rights.

Violations of human rights are still an everyday event. Human rights violation that across state borders, widening of gap between the “have" and “have not", gender based poverty that impact women, poverty that continue through generations, trafficking of humans, exploitation of domestic workers, child soldiers, political prosecutions are all modern day problems. In China, the June 4 incident of political suppression, the families of those killed still being denied the rights to openly mourn for the dead. Political dissidents and human rights defenders still risk losing their freedom, when they try to help those human rights being violated. Human rights lawyers still face oppression when they visit potential victims. In Hong Kong, situation is not that much better. The interfering to court judgments when they uphold human rights standard, people in Hong Kong people still not having their rights of universal suffrage recognized and elect the Chief Executive and Legislators, the police abuse their powers, insufficient anti-discrimination laws, and the threat of diminishing freedom of speech and press, citizens lack power of negotiation on city planning, sexuality rights of women being oppressed, lack of protection of political asylum seekers and refugees, children rights of self determination and dignity being violated with forceful implement of random drug tests in schools. When we lost the most basic human rights, we lost the rights to determine for our lives. Without self determination, where are my human rights?

To protect our most basic human rights, so that we could live with self determination and dignity, we need an independent human rights institution with rights to oversee all human rights issues. United Nations have advised Hong Kong government to establish a national human rights institution, yet the Hong Kong government had made excuse not to implement accordingly. Currently, human rights protections are scattered under several institutions like the Equal Opportunities Commission, Data Privacy Commission, and Independent Police Complaints Council. The mandate for these institutions are narrow, and the appointment procedure lack transparency, some departments lack the resources to do the properly. These institutions could not protect human rights comprehensively. Based on these factors, we strongly urge the government to establish a human rights institution.

In order to effectively protect human rights for all, government policies are important, but our own awareness of our rights is even more important. We are the masters of our lives and made decisions for ourselves without interference by others. If we really want our human rights being recognized, we need to be aware and have the courage to fight for our human rights. For this, we urge each individual to join together in the rights for human rights, and to counteract the injustices in society.

【活動簡介】

「沒有自主,人權何在?──國際人權日2009」嘉年華

今年(2009年),香港的侵權之事層出不窮,29個活躍的民間團體將於明天舉辦「國際人權日2009」嘉年華,向市民表達香港近年最熱門的人權議題。

今年參與團體有關注中國人權及維權人士組織、關注驗毒計劃的青年團體、關注市區重建議題的組織、以及關心勞工、外傭、性工作者和及同志的團體等。各團體的其中一個共同的強烈訴求,是要求政府立即設立人權委員會,以改善各範疇的人權狀況,各團體將聯合進行一項「沒有自主,人權何在?」的行動表達此訴求。

中學生遊學團 通識教育學人權

今年的嘉年華增設了專為中學生通識科目設計的「遊學團」,由「人權嚮導」帶領中學生親歷各民間團體的人權訴求。
